Terms of service.

1. Agreement

By accessing or using Potio (the “Service”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use Potio

You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for ensuring that your use of Potio, and any poker or home-game activity you coordinate through it, is lawful in your jurisdiction.

3. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your credentials secure and for all activity under your account.
• Notify us immediately at security@potio.gg if you suspect unauthorised access.
• We may suspend or terminate accounts that violate these Terms or that threaten the Service or its users.

4. Clubs and roles

Potio lets you create and join private clubs. Each club has Owners, Admins, and Members with different permissions. Owners are responsible for the conduct of their club, the accuracy of the data recorded, and the treatment of members. Admins act on behalf of Owners. Members are responsible for their own contributions to the ledger.

5. Real-money settlements

Potio is a coordination and tracking tool only. Buy-ins, cash-outs, rebuys, and settlements represent agreements between players. Potio does not process, hold, transfer, escrow, or guarantee any funds, and does not verify the accuracy of amounts entered. All disputes about money are between the players involved. You agree that Potio is not a party to any such transaction.

6. Acceptable use

You agree not to:

• Use the Service for any illegal gambling activity or in violation of applicable law.
• Impersonate anyone, misrepresent balances, or falsify game data.
• Harass, threaten, or defraud other users.
• Attempt to breach or circumvent security, access other members' data, or scrape the Service.
• Reverse engineer, resell, or build a competing product from the Service.
• Upload malicious code or content that infringes intellectual property or privacy rights.

7. Content you provide

You retain ownership of the content you upload (club names, icons, banners, notes, messages). You grant Potio a worldwide, non-exclusive, royalty-free licence to host, display, and process that content solely to operate the Service. You are responsible for having the rights to any content you upload.

8. Intellectual property

The Potio name, brand, interface, and code are owned by Potio and protected by applicable laws. Nothing in these Terms grants you any right to our trademarks or branding without our prior written consent.

9. Fees

Potio is currently free to use. We may introduce paid plans in the future. If we do, we will give you clear notice before any charges apply and will not charge you without your consent.

10. Beta features

We may release features labelled beta, preview, or experimental. They are provided as-is, may change or be removed at any time, and may contain bugs. Use them at your own risk.

11. Termination

You can delete your account at any time from your settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. On termination, the licences you have granted us continue only to the extent needed to preserve other members' club history.

12. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Potio disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be accurate.

13. Limitation of liability

To the fullest extent permitted by law, Potio and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of GBP 50 or the amount you paid us in the twelve months before the claim.

14. Indemnity

You agree to indemnify and hold Potio harmless from any claim arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

15. Governing law

These Terms are governed by the laws of England and Wales. You and Potio agree to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections in your country of residence.

16. Changes

We may update these Terms from time to time. If changes are material, we will notify you inside the Service. Continued use after the effective date means you accept the updated Terms.
